Terms of Service
These terms cover the WanderWay app for iPhone and CarPlay and the WanderWay service behind it. By installing or using WanderWay you agree to them.
Who provides WanderWay
WanderWay is published by Derek Boyer, an independent developer established in the United States. Contact [email protected] with questions about these terms.
Your license to use the app
WanderWay is licensed, not sold. Subject to these terms, you may install and use the app on Apple devices you own or control, for your personal, non-commercial use. The app is distributed through the App Store, and Apple's standard Licensed Application End User License Agreement also applies. If it conflicts with these terms, these terms govern your relationship with the publisher; Apple is not responsible for the app or its content and may enforce these terms as a third-party beneficiary.
You may not copy, modify, distribute, sell, rent, or reverse engineer the app, extract its data or content for use outside the app, or use automated tools to query the WanderWay service, except where the law allows it regardless of this restriction.
Free trial and purchase
WanderWay is free to download. Every feature is available free for a trial period after you first open the app (14 days at the time of writing; the app shows the current length). After the trial, some features need a one-time in-app purchase of full access. There is no subscription and no advertising.
Purchases are made through Apple's in-app purchase system and are subject to Apple's terms. Apple handles billing, receipts, and refund requests; the publisher cannot issue refunds directly. Full access is tied to your Apple Account and can be restored on your other devices from the app's settings. Prices are shown in the App Store for your country and may change for future purchases.
Safe driving
WanderWay is a sightseeing and navigation aid, not a substitute for your attention or judgment. Always obey traffic laws, road signs, and conditions, and keep your eyes on the road. Set up your drive before you leave, let passengers handle the phone, and use CarPlay or voice guidance while moving. Do not read stories or browse places while driving.
Routes, turn instructions, and estimates come from Apple Maps and can be wrong or out of date. Roads can be closed, private, seasonal, or unsuitable for your vehicle. You are responsible for deciding whether a route and a stop are safe and lawful for you.
Places, stories, and other content
Place listings, categories, descriptions, photos, hours, fees, weather, and byway information come from community and public sources, including OpenStreetMap, Wikipedia, Wikidata, Wikimedia Commons, Wikivoyage, the National Register of Historic Places, the National Park Service, Recreation.gov, MET Norway, the US National Weather Service, Mapillary, Open Charge Map, and the US Department of Transportation. The publisher does not verify this content. A place shown in the app may be closed, moved, on private land, or different from its description. Check before you visit, and respect posted rules and property owners.
Spoken stories and summaries are generated from that content and can contain errors. They are provided for interest, not as authoritative history or travel advice.
Third-party content remains subject to its own licenses, which the app credits where they apply. Attribution shown in the app must not be removed.
Corrections you submit
If you report a place correction, you grant the publisher a worldwide, royalty-free license to use, store, edit, and share the report, including with OpenStreetMap or other data maintainers, to improve place information. Submit only information you have the right to share, keep it about the place rather than people, and do not include personal information, offensive material, or anything unlawful. Reports may be reviewed, edited, or discarded without notice.
Your data
How WanderWay handles location, saved trips, diagnostics, and correction reports is described in the Privacy Policy, which forms part of these terms.
Third-party services
The app relies on Apple Maps, Apple Speech, CarPlay, and the services named above. Their availability and accuracy are outside the publisher's control, and your use of them is subject to their own terms. Features may change or stop working if a provider changes or withdraws a service.
Availability and changes
The publisher may update, change, or discontinue the app or any feature at any time, and may suspend the WanderWay service for maintenance or to prevent abuse. Reasonable efforts are made to keep purchased features working on supported iOS versions, but no particular feature or level of availability is guaranteed. Support for older iOS versions may end as Apple retires them.
Disclaimer of warranties
WanderWay is provided "as is" and "as available". To the fullest extent permitted by law, the publisher disclaims all warranties, express or implied, including fitness for a particular purpose, accuracy, and non-infringement, and does not warrant that the app will be error-free, uninterrupted, or that any route, place, or story is accurate, safe, or lawful to visit.
Limitation of liability
To the fullest extent permitted by law, the publisher is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of or inability to use the app, including damages from accidents, traffic violations, trespass, closed or inaccurate places, or reliance on routes or content. The publisher's total liability for any claim relating to the app is limited to the amount you paid for it in the twelve months before the claim, or US$20 if you paid nothing.
Some jurisdictions do not allow certain exclusions or limitations. Nothing in these terms limits liability that cannot be limited by law or affects statutory consumer rights, including under EU and UK consumer law, that cannot be waived.
Termination
You may stop using WanderWay at any time by deleting it. The publisher may end your license if you breach these terms or misuse the service. Sections about content, liability, and governing law continue to apply after termination.
Governing law
These terms are governed by the laws of the State of Ohio and the United States, without regard to conflict-of-law rules, and disputes are subject to the courts located in Ohio, unless the consumer protection law of your country of residence requires otherwise. If you live in the EEA or the UK, you keep the protection of the mandatory laws of your country and may bring claims in its courts.
Changes to these terms
These terms may be updated as WanderWay changes. The effective date at the top will be revised when an update is published, and the app may point to the new version. Continuing to use the app after a change means you accept the updated terms.
